Stults V. Iff; 8th Circuit Court Of Appeals Affirms Verdict
April 13, 2016

On March 4, 2016, the 8th Circuit Court of Appeals affirmed the district court's entry of a defense verdict in favor of International Flavors and Fragrances, Inc. (IFF) in the matter of Stults v. American Pop Corn Co., et. al., ---F.3d --- 2016 WL 853283. Jeff W. Wright served as local counsel for IFF, working the trial team of Earl W. (Billy) Gunn, Alan Holcomb, Rick Hill and David Matthews of Weinberg Wheeler Hudgins Gunn & Dial, of Atlanta, GA. At trial, the plaintiffs alleged Mr. Stults developed a lung condition from inhaling microwave popcorn aroma and that IFF knew or should have known it was including a substance in its popcorn flavor that caused the lung condition. The jury returned its defense verdict in August 2014 following a two week trial in the United States District Court for the Northern District of Iowa.
