Pat Sealey and the Heidman Law Firm, on behalf of the developer of the Whispering Creek residential subdivision in Sioux City, successfully defended an appeal to the Iowa Supreme Court. The Iowa Supreme Court found that Iowa law does not recognize an implied warranty of workmanlike construction on the sale of a residential lot with no dwelling. Judge Hoffmeyer, of the Iowa District Court for Woodbury County, and the Iowa Court of Appeals had previously reached the same decision on this matter.
